When an insurance company refuses to pay a valid claim, delays without justification, or undervalues a settlement to protect its bottom line, the people the policy was meant to protect are left carrying the loss. That harm falls on policyholders denied the coverage they paid for, and on injured claimants whose recoveries are stalled or suppressed by the insurer on the other side. The law recognizes that insurers owe a duty of good faith and fair dealing, and allows recovery beyond the policy itself when that duty is broken. These cases require going up against the highly paid defense firms insurers keep on retainer to fight these matters as a routine cost of doing business.
